2018 Complaints, Appeals and Resolutions

As per UVSS Electoral Policy 8.2 h, the Electoral Office will publish all complaint decisions online but will not reveal the original complaint or response.

Complaint # 1.

Issue: The Electoral Office/CEO did not accept a submission as a complete nomination.

Appealed to the Elections Adjudicator.

Decision:  Complainant was in violation of UVSS Electoral Policy sections 3.3 a ii 1, 4.2 a i, 4.2 a ii, 4.3 c and 5.1 a.   Ruling of the Electoral Office/CEO upheld.

 

Complainant #2:

Issue: The Electoral Office/CEO disqualified a nominee from being  an official candidate.

Referred to the Elections Adjudicator.

Decision:  Complainant was in violation of UVSS Electoral Policy 5.1 a while violations of 4.2 a i and 4.3 a, were under review.  Ruling of the Electoral Office/CEO to disqualify upheld by Elections Adjudicator.

Appealed to the Arbitration Panel.

Decision: Panel confirms the Electoral Office/CEO’s decision that the Appellant’s nomination must be disqualified for breaches of Electoral Policy sections 4.2 a i, 4.3 a and 5.1 a.  Unanimous.

 

Complaint #3:

Issue:  Complaint was made that a candidate had print material posted in violation of Electoral Policy section 5.4 (o).

Resolution: In response to initial contact, candidate immediately admitted error, removed and recycled materials in violation within 30 minutes, and self-imposed a penalty of not replacing the materials for over 24 hours.

The Electoral Office considers this issue closed.

 

Complaint #4:

Issue:  Complaint was made that a candidate had print material posted in violation of Electoral Policy section 5.4 (k).

Resolution:  Materials in question had already been removed, and recycled, by the candidate before this complaint could be investigated.

The Electoral Office considers this issue closed.

 

Complaint #5:

Retracted.

 

Complaint #6:

Issue: Complaint was made that a slate had campaign material posted in violation of UVic Signage Policy which had caused damage to University property.

Resolution:  Slate members have admitted violation, have written letters of apology, have offered to compensate for damages, and have participated in additional training on the Electoral Policy.  The complainant has requested compensatory donations to the food bank in lieu of payment for damages. Accepted by complainants and respondents.

Assuming the slate members fulfill the obligation of compensatory donations, the Electoral Office considers this issue closed.

 

Complaint #7:

Issue: Complaint was made regarding treatment of staff at a SUB business by two candidates of a slate.

Resolution:  Candidates have apologized for their behaviour and actions, and have agreed to take leadership roles in developing anti-bullying policy and procedures for UVSS.  Accepted by complainants and respondents.

Assuming the candidates fulfill the obligations of leadership work on anti-bullying,  the Electoral Office considers this issue closed.

 

Complaint #8:

Issue: A UVSS fee-levied organization informed a slate that statements made in their campaign platform were defamatory.  When the response by the slate was deemed inadequate by the organization’s Board of Directors, a formal complaint was made.

Resolution: All slate members have submitted a letter to the Board of Directors, acknowledging the error in their platform and the potential for the statement to cause damage to the organization’s reputation.  This letter will also be publicly posted.  On their own time and expense, all slate members will be taking additional training related to non-profit governance. Resolution accepted by all complainants and respondents.

Assuming all slate members fulfill the obligation of publicly posting their statement of apology and participate in the governance training, the Electoral Office considers this issue closed.

 

Complaint #9:

Issue: Two candidates self identified as having committed two infractions of the Electoral Policy.

Resolution: As soon as the candidates identified that their actions were in violation of the campaign rules, the candidates took steps to clarify and reverse their actions with a UVSS member who was involved, and reported the incidents to the Electoral Office.  Both candidates wrote statements on how they found themselves to be in violation of the Electoral Policy to be used in training materials for candidates for future years.

The Electoral Office considers this issue closed.
